Police, Lawyers And Judges Training In India By PTLB

Technology related or digital issues are not popular either among the legal or among the judicial community of India. This is the reason why cyber law and cyber forensics related issues are seldom found mention in the courts. However, the future belongs to technology related disputes and their resolution.

While foreign countries are giving lots of emphasis to cyber related education and training, India is not doing enough in this regard. Crucial training areas like lifelong learning or continuing legal education (CLE) are still missing in India.

The bar council of India (BCI) is the main authority that is responsible for improving standards of legal professionals in India. Till now, BCI has not been able to materialise its objective of providing scientific and technical professional training to lawyers in India.

The problem seems to be lack of management and expertise in this regard in India. Even Law Ministry of India has not been able to contribute significantly in this direction. Although Law Minister Veerappa Moily has promised many legal and judicial reforms, yet they are still in pipeline. Till these reforms are actually implemented, legal and judicial standards in India cannot improve.

Even the law enforcement agencies of India are not aware of cyber crimes and cyber law related issues. They do not know how to deal with cyber related issues much less how to handle digital evidence. There is also lack of proper cyber law and cyber forensics training for law enforcement agencies of India.

On the other hand, other nations are working really hard in this regard. Take the example of U.S. Attorney's. The U.S. Attorney's Office has sponsored its first "Cyber Crime, Electronic Evidence, and Cyber Security Training" for local and federal law enforcement officials. The purpose of the training is to equip law enforcement agencies of US to deal with cyber crimes.

Entrance Examination For Admission To Bar Of India

Indian educational systems has failed to cope up with the contemporary requirements of society on the one hand and business community on the other. Take the example of legal education in India. Legal education is one of the tools that can act as an instrument of social change in India. However, the colonial nature of Indian educational system, including Indian legal education, has prevented it from achieving this benign objective. To aggravate the situation, Indian educational system is “academic” in nature whereas the present time and competition demands a “professional and practical approach”.

Legal and judicial reforms in India are long due and Indian government must do something about it urgently before it is too late. One such crucial reform pertains to qualitative professional and practical legal education. After all the strength and capacity of both Bar and Bench is measured by and reflected in the quality of law graduates. Both Bar and Bench derives their intellectual strength from their experience, learning and knowledge acquired at law colleges/schools.

Realising the importance of qualitative legal education and skill, the Supreme Court of India has recommended to Centre/Bar Council of India (BCI) to conduct bar examinations to test candidates for their suitability or otherwise for entry into the legal profession. This has saved us lot of hard work and trouble to dig up the matter for our viewers.

So finally, law graduates are moving towards a knowledge curve that would shape their legal practice forever. The only question that remains to be answered is whether India is capable of implementing this ambitious plan? I hope, and wish, the answer should be in positive. Techno-Legal E-Courts Training Centre Launched By Perry4Law

India is at the initial stages of establishment of electronic courts (e-courts). Though India has done a good job by computerising the courts at various levels yet it is still far from the establishment of even the first e-court of India. It seems the e-courts project of India needs a techno-legal training boost.

Perry4Law and PTLB have launched the first ever e-courts training and consultancy centre of India and perhaps first of its kind in the World. A “prototype” of the same is available to the public and stakeholders till the final website is out.

Efforts in the direction of establishment of e-courts in India have been in process since 2003 and significant development in the sphere of computerisation has already been achieved. It is at this stage that there seems to be stagnation of e-court project of India and this initiative by Perry4Law would facilitate in the smooth and hassle free migration of e-court project to the next level.

India must understand that E-courts are much more that mere connectivity and computerisation of traditional courts. The moment e-filing, presentation, contest and adjudication of the cases in an online environment would start, India would surely be capable of establishing e-courts.

Techno-Legal Education In India Got A Boost

Legal education in India is in the process of transformation. However, there are urgent educational and legal reforms that must be undertaken by India as soon as possible. One such area that requires urgent attention is the amalgamation of legal education with information and communication technology (ICT). For instance, cyber law is an important facet of such an interaction of technology and law.

Indian educational system is more academic than professional. As a result although India has good population that is academically sound yet when it comes to practical and real life experience and work, they do not perform reasonably well. Various studies and research in India have suggested that out of the educated masses only 15 to 25% are fit for being absorbed at job places.
